Open work permit

You can work for any employer as long as you have an open work permit.

You may be eligible for an open work permit if you:

  • graduated from a designated learning institution and are eligible for the Post-Graduation Work Permit Program
  • are a student who can no longer afford the cost of studies in Canada (destitute student)
  • have an employer-specific work permit and are being abused or at risk of being abused in relation to your job in Canada
  • applied for permanent residence in Canada or are a dependent family member of someone who applied for permanent residence
  • are the spouse/common-law partner of a skilled worker or international student
  • are the spouse/common-law partner of an applicant of AIPP
  • are a refugee, refugee claimant, protected person or their family member
  • are under an unenforceable removal order
  • are a temporary resident permit holder
  • are a young worker participating in special programs.

    Employer-Specific work permit

    The process of obtaining a work permit in Canada usually starts with getting a job offer from a Canadian employer. In most cases, a job offer must be approved by Employment and Social Development Canada (ESDC), a government institution. Terms and conditions of employment must comply with Canadian immigration law criteria, and an employer should be able to demonstrate to Employment and Social Development Canada that he or she made every effort to fill the position but could not find a suitable qualified Canadian or permanent resident for the position.

    Once a job offer is approved by Employment and Social Development Canada, a foreign worker can apply for a work permit with Immigration, Refugees and Citizenship Canada (IRCC), and IRCC will determine whether the foreign worker is eligible to come and work in Canada.
